1. Award Competition Description:
The “The Sally Ride-Deloitte 2014-15 Award for Teaching Innovation in STEM” (the “Award Competition”) is sponsored by Sally Ride Science, Inc., with its principal place of business located at 9171 Towne Centre Drive, San Diego, CA 92122 (“Sponsor” or “SRS”) and Deloitte Services LP, a Delaware limited partnership, with an office at 1633 Broadway, 38th Floor, New York, NY 10019 (“DS”). The Award Competition will begin on or before 11:59:59 PM Pacific Time (“PT”) on July 15, 2014 and will close for entries at 11:59:59 PM on October 31, 2014, 2014 (the “Submission Period”). THE AWARD COMPETITION IS VOID WHERE PROHIBITED OR RESTRICTED BY LAW. BY ENTERING THE AWARD COMPETITION, EACH ENTRANT ACCEPTS AND AGREES TO BE BOUND BY THESE OFFICIAL AWARD COMPETITION RULES (the “Official Rules”).
To be eligible, an entrant (“Submitter”) must (i) be an educator who is either primarily employed full-time (Y) teaching students in Grades K-12; or (Z) as a library media specialist or technology specialist/coordinator; in either case in an accredited public or private school in the U.S.; and (ii) be at least eighteen (18) years old at time of entry and a legal resident of one of the fifty (50) United States or the District of Columbia; and (iii) be the author or inventor of a new a device, presentation, lesson plan, software, video, multimedia asset, app, website, game, or other tool usable by teachers and/or students to enhance interest in, or understanding of, a STEM (Science, Technology, Engineering or Math) concept or career (“Innovation”). Entry is limited to one (1) submission per Submitter. Each Submitter may only enter the Competition one time and for only one Innovation. Multiple entries from the same Submitter will be disqualified. Eligibility is further limited to one (1) person per submission. Entries from teams of people will be disqualified. Employees of and immediate family members of employees of SRS, DS or their affiliates are not eligible to participate in the Award Competition. No purchase is necessary. Sponsor reserves the right to disqualify ineligible entries; materials from such entries, if any, will not be returned.
3. How To Enter:
Each Submitter may enter the Award Competition by either completing an online submission form found at URL https://www.sallyridescience.com/stem-central/innovation-award-2014#submitentry or by mailing in an entry form. Each complete entry (whether online or mailed-in) must include your first name, last name, your school or organization, zip code of your school or organization, type of educator (e.g. teacher, specialist, administrator, etc.), a description of your innovation (topic area, media type, grade level, key words, etc.), and a link to a web page, video clip, PDF file or other online asset with text and images that depict or describe how your Innovation works, the group(s) of students it targets and the benefits that students or teachers derive from it (each complete entry, a “Submission”). Mailed Submissions must be sent to The Sally Ride-Deloitte 2014-15 Award for Teaching Innovation in STEM, 9171 Towne Centre Drive, San Diego, CA 92122. IF YOU ENTER ONLINE, PLEASE CHECK THE BOX INDICATING THAT THE SUBMISSION IS INTENDED FOR THE AWARD COMPETITION AND THAT THE SUBMITTER HAS READ, AND AGREED TO, THESE OFFICIAL RULES. We recommend that video clips not exceed 2 minutes in length and/or that supporting text does not exceed 500 words in length. Any fees incurred by the Submitter in creating or hosting the online assets will be the sole responsibility of the Submitter.
The Innovation may be intended for use outside of traditional classroom instruction in science or math but must have a stated instructional goal and a target group of students or teachers and be usable by a diverse range of students or teachers typical of the target group. The Innovation must not require special skills or understanding on the part of teachers or students that would be unusual in the target groups of users. The link describing the Innovation must remain accessible to judges and functional online at the linked location from the date of Submission through January 31, 2015, the official end of the judging period.
SRS will moderate all Submissions for general appropriateness of content before displaying them on its STEM website (“STEM Central”). This moderation period may take up to five business days. It is up to each Submitter to ensure that his/her Submission is eventually displayed on STEM Central. The Sponsor is not responsible for any Submissions which are lost, late, garbled, corrupted, unintelligible, misdirected or otherwise lost or deleted - whether as a result of human, technical or other error - or for any incomplete or invalid entries, all which will be disqualified. The Innovation may not incorporate intellectual property rights that are: 1) held by any private entity other than the Submitter, or 2) that would not be readily available for use by target users (e.g. Innovation may incorporate use of a spreadsheet or presentation program that is readily available to schools).
Effective upon submission, Submitter hereby grants Sponsor and DS a non-exclusive, irrevocable license to link to and/or display the Submission, including, but not limited to, all information about Submitter and the Innovation, in whole or in part, on STEM Central, the Sally Ride Science web site, or on other web sites operated by the Sponsor or DS for commercial purposes, without any payment or other consideration, for use on any media now known or hereafter discovered, for at least one year after the announcement of Award Competition winners, to the extent legally permissible. You understand that, other than the opportunity to enter the Award Competition program, you will not be paid any money or receive any other consideration or form of compensation for giving Sponsor these rights. You further understand you will not be reimbursed for any costs you may have incurred in connection with your Submission. Sponsor reserves the right to edit Submission content, including, but not limited to, any photographical or video material comprising, in whole or in part, the Submission. You represent that you own all rights, title, and interest in the Submission or that you otherwise have authority to submit the Submission and to grant the license described herein. You represent that you have obtained all permissions, clearance, and releases from any third parties necessary to allow your Submission and SRS's use of the Submission, as set forth herein.
4. Important Tips:
Look for notification from Sally Ride Science that a Submission has been received for the Award Competition. Make sure to check the e-mail account used in connection with the Submission, as any notifications or communication will be sent via e-mail. Submitters who do not win will not receive notification of prize winners unless they specifically request a list of winners, as provided below. Submitter must read the Official Rules in full before submitting a Submission.
5. Winner Selection:
Sponsor's decisions as to the administration and operation of the Award Competition and the selection of potential winners are final and binding in all matters related to the Award Competition. Submissions will be evaluated by a panel of judges consisting of educational advisors and STEM professionals selected by Sally Ride Science, in its sole discretion. The judging panel will also include at least one member from Sally Ride Science. Judges will not be permitted to enter the Award Competition.
Each entry will be scored individually. The entries will be judged on the following criteria:
- Innovation reflected in the Submission, in comparison with other instructional tools or resources that may already be available.
- Uniqueness of the Innovation, particularly as applied toward the targeted goal and user group.
- Creativity exhibited in the concept, design or execution of the Innovation.
- Applicability of the Innovation for its expressed purpose.
- Usability of the Innovation among teachers and students in the target group.
- Likely pedagogical effectiveness of the Innovation.
- Practicality of the Innovation, in terms of cost and time required for use.
- Preference will be given to Innovations that show particular potential for reaching girls and under-represented minority students.
Judges will be required to abstain from judging if a conflict of interest is or becomes present. Winners will be determined after the Submission Period concludes on October 31, 2014, and will be announced prior to February 28, 2015. The top scoring Submission will be considered a First Place finalist. The second and third highest scoring Submissions will be designated as Second Place finalists. The fourth through eighth highest scoring Submissions will be designated as Third Place or Honorable Mention finalists. In the event of a tie in scoring, tied Submissions will be resubmitted to the judges for rescoring, according to the criteria above in this Section 5. The tied Submissions will then be re-ranked according to the rescoring, and be considered for prizes in the order of their respective scores. In total, once judging is completed, there will be eight Submissions selected as finalists. Sponsor reserves the right to terminate the Award Competition without awarding prizes if no eligible winner or alternate winners claim the prizes within the required time. ALL FINALISTS/ POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR. A FINALIST IS NOT A WINNER OF ANY PRIZE UNLESS AND UNTIL SUBMITTER'S ELIGIBILITY AND FULL COMPLIANCE WITH THESE OFFICIAL RULES HAS BEEN VERIFIED AND SUBMITTER HAS BEEN NOTIFIED BY SPONSOR THAT VERIFICATION IS COMPLETE.
The Award Competition has three prize levels of award finalists-First, Second and Third (or Honorable Mention). SRS will notify all finalists via e-mail before February 15, 2015. Finalists must respond via e-mail and/or as otherwise instructed to do so in the notification, within five (5) days of the date of notification, in order to confirm their acceptance of their respective awards and compliance with these Official Rules. Finalists must respond by sending a response e-mail to the SRS staff member who notified the finalist of the award by completing and returning a signed affidavit of eligibility and a liability release form (except where prohibited), without modification. The affidavit and liability release form are intended to assure finalists' adherence to these Official Rules and will reflect terms already described in these Official Rules. If a finalist of any prize cannot be contacted, fails to sign and return the affidavit and liability release form within the required time period (except where prohibited), or if the prize is returned as undeliverable, such finalist forfeits the prize. In the event that any finalist is disqualified for any reason, Sponsor will eliminate such finalist and award the prize to the next highest scoring Submission from among all remaining eligible Submissions, thereby moving all such eligible Submissions up one level. All alternate potential winners are subject to all requirements set forth in these Official Rules. Only three (3) alternate winners will be selected after which a prize will remain un-awarded. Each institution/organization is solely responsible for any and all federal, state and local taxes (including any income and withholding taxes) that may be imposed upon the award paid to it. Sponsor reserves the right, at its sole discretion, to substitute prize of comparable or greater value.
First Place. There will be one (1) First Place prize winner who will receive the right to designate a $5,000 USD award to an educational institution or organization of his/her choosing. In addition, the First Place prize winner will receive the ability to designate an educational institution or organization to receive a free one-year subscription to the Sally Ride All-Access Site License (see https://sallyridescience.com/learning-products/site-licenses#.U3JZSvldWSo) for use of educators and students at such institution or organization.
Activation of the site license is subject to acceptance of the Sally Ride All-Access Site License Terms and Conditions by the organization or institution designated by the winner to receive the Sally Ride All-Access Site License.
TOTAL APPROXIMATE RETAIL VALUE OF FIRST PLACE PRIZE: $9,000 USD.
Second Place. There will be two (2) Second Place prize winners, each of whom will receive the ability to designate a $2,500 USD award to an educational institution or organization of their choice. Both Second Place prize winners will also receive the ability to designate an institution or organization to receive a free one-year Sally Ride All-Access Site License for use of educators and students at each designated single location.
Activation of the site license is subject to acceptance of the Sally Ride All-Access Site License Terms and Conditions by the organization or institution designated by the winner to receive the Sally Ride All-Access Site License.
APPROXIMATE RETAIL VALUE OF EACH SECOND PLACE PRIZE IS $6,500.
Third Place. There will be a total of five (5) Third Place prize winners, each of whom will receive the ability to designate a $1,000 USD award to an educational institution or organization of their choice. .
APPROXIMATE RETAIL VALUE OF EACH THIRD PLACE PRIZE IS $1,000 USD.
Odds of winning depend upon the number of eligible entries Submissions received by Sponsor.
8. Release and Disclaimer of Liability:
Except where prohibited by law, by participating in the Sweepstakes each Submitter individually agrees to release, discharge and hold harmless, Sponsor, DS, and their respective parents, affiliates, related entities, subsidiaries, distributors, suppliers, advertising and promotional agencies, and any other individuals engaged in any way in the development, production, printing, distribution or execution of this Award Competition, and the respective directors, officers, agents, representatives, personnel, shareholders, and employees of the foregoing (collectively, the “Released Parties”) from any liability, claims, losses and damages of any kind arising out of, or relating to, their participation in this Award Competition.
Released Parties do not assume any responsibility and the Submitter releases the Released Parties from any and all claims, actions, damages, demands and liabilities of whatever nature or kind arising out of, or in connection with the Submitter's participation or attempted participation in the Award Competition, including, without limitation, the administration of the Award Competition, the selection and confirmation of the winners, and the arranging, awarding and use of the prize. Without limiting the generality of the foregoing, the Released Parties are not responsible for (i) the incorrect or inaccurate capture of entry information; (ii) late, lost, stolen, contain false information, damaged, misdirected, garbled or incomplete entries, transmissions or transactions, those that are altered or otherwise irregular, have been submitted through illicit means or do not conform with or satisfy any or all of the conditions of these Official Rules; (iii) any loss, damage, or claims caused by, or in any way related to the awarded prize or the Award Competition itself; (iv) failure of any operations or transmission of information during the Submission Period, including, without limitation, any problems, human or technical, errors, lost, delayed, garbled or corrupted data or transmissions, omissions, interruptions, deletions, defects or failures of any telephone or transmission lines, technical malfunctions of any computer on-line systems, servers, access providers, computer equipment, software, failure of any e-mail or entry to be received on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof including, without limitation, any injury or damage to an entrant's or any other person's computer related to or resulting from participating in or downloading any material connected to the Award Competition, all of which may affect a person's ability to participate in the Award Competition; (v) any errors, omissions, incorrect or inaccurate information in any Award Competition-related materials, including, without limitation, printing or advertising errors or the failure of or problems with any equipment or programming associated with or used in the Award Competition howsoever caused; (vi) the security or privacy of information transmitted via computer networks or for breaches of privacy due to interference by third party computer "hackers" or otherwise; (vii) any claims regarding the accepting, arranging, awarding or use of a prize; or (viii) electronic communications which are undeliverable as a result of any form of active or passive filtering of any kind. Entry material/data that has been tampered with or altered is void.
By entering this Award Competition you consent and agree to Sponsor's Privacy Notice, a copy of which may be found at URL https://sallyridescience.com/privacy-policy#.U3U-IvldWSo (“Privacy Notice”). Personal information collected from Submitter will be used by Sponsor to (i) administer the Award Competition, (ii) send communications relating to the Award Competition, including complying with requests for the winners' list, (iii) notify the winners and award prizes, and (iii) analyze performance of the Award Competition on an anonymous basis, as stated in the Privacy Notice. Sponsor may also use your information to contact you regarding this Award Competition or to promote with marketing communications (for example, e-Mails containing coupons, product information or future promotional information). Your consent to Sponsor's use of your information for marketing purposes may be revoked at any time (without revoking your participation in the Award Competition or impairing your chances of winning) by following the opt-out procedures provided with any electronic marketing communications. All Submitters agree to the use of their names and likenesses in publicity without notice or any additional compensation, except where prohibited by law. By entering this Award Competition, the Submitter acknowledges that Sponsor and DS have the right to publicize and broadcast his or her name, voice, and likeness, the fact that they won a prize, if applicable, and all matters incidental thereto.
The Award Competition and these Official Rules are subject to modification by Sponsor and or DS in their sole discretion. You represent that the Submission does not contain material that is (a) unlawful, obscene, offensive, defamatory, libelous, threatening, fraudulent, abusive, pornographic, harassing, or encourages conduct that would be considered a criminal offense, or does or could give rise to civil liability or violate any law, rule, or regulation, or is otherwise objectionable; (b) non-public information about any company that you are not authorized to disclose; and (c) an advertisement, solicitation, chain letter, pyramid scheme, investment opportunity, or other unsolicited commercial communication; (d) otherwise in poor taste or not appropriate for use in a classroom, at the sole discretion of the Sponsor. Any Submissions containing any of the above will be automatically disqualified at the sole discretion of the Sponsor.
If for any reason the Award Competition is not capable of running as originally planned, including should any virus, worm, bug, technical failures, unauthorized human intervention or other causes corrupt or affect the administration, security, fairness or proper conduct of the Award Competition or STEM Central, Sponsor reserves the right to terminate the Award Competition. In the event of any such termination or suspension, a notice shall be posted at URL https://www.sallyridescience.com/stem-central/innovation-award-2014.
Any attempt by any person to deliberately undermine the legitimate operation of the Award Competition may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor and DS reserve the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
You guarantee that any persons whose name, image, likeness, or personal information is used or depicted in the Submission have validly consented to such use or depiction. Valid consent shall mean the knowing, written acquiescence of such use or depiction as part of the Submission signed by the person whose name, image, likeness, or personal information is used or depicted. In addition to the foregoing, valid consent with respect to the use or depiction of any minor's name, image, likeness or other type of personal information, shall also include the knowing, written acquiescence of such use or depiction as part of the Submission signed by the minor's parent or legal guardian. Such use or depiction must also be done according to the terms, if any, of the school, institution, and/or School Board to which the student belonged at the time such image, likeness, or other information was obtained. Submissions that are submitted in violation of any school, institution, or School Board's terms, will invalidate the Submission. At discretion of the Sponsor, Submitter may be required to provide proof of compliance with all terms herein. Failure to provide proof of valid consent or adherence to any applicable terms, as described above, to the satisfaction of Sponsor, will result in the invalidation of that particular Submission. In the event of Submission invalidation, Submitter will no longer be eligible to participate in the Award Competition program, and will have no recourse or other opportunity to submit a Submission.
11. Request for Awardees List and Official Rules:
Requests for Awardees List and/or Official Rules can be made to STEMawards@sallyridescience.com or Sally Ride Science, Inc., 9171 Towne Centre Drive, San Diego, CA 9212, within ninety (90) days of expiration of the Submission Period.
This Award Competition and these Official Rules shall be governed by the laws of the state of CALIFORNIA. Any and all claims or disputes arising out of or in connection with this Award Competition shall be made individually and in no event in the form of a class action, and shall be made in the applicable state or federal court in the city of SAN DIEGO, CA without regard to any conflicts of law principles, and Submitter hereby submits to the exclusive jurisdiction of such courts in SAN DIEGO, CA and waives any and all rights to object to the exclusive jurisdiction and venue of such courts. Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Award Competition, but in no event attorneys' fees. UNDER NO CIRCUMSTANCES WILL SUBMITTER BE PERMITTED TO OBTAIN AWARDS FOR, AND SUBMITTER HEREBY WAIVES ALL RIGHTS TO CLAIM, INDIRECT, PUNITIVE, INCIDENTAL AND CONSEQUENTIAL DAMAGES AND ANY OTHER DAMAGES, OTHER THAN FOR ACTUAL OUT-OF-POCKET EXPENSES, AND ANY AND ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED.
